Frank v. Frank
Facts:
Defendant wife appealed from a decree of the Circuit
Court of Loudoun (Virginia), which overruled her demurrer to plaintiff
husband's bill of complaint seeking divorce based on cruelty and adultery. The
wife asserted that the trial court erred in reading the deposition of a
complainant, and that there was insufficient evidence to support a finding of
adultery.

Holdings:
The
Virginia Court made the following holding:
- Condonation is a matter
of specific affirmative defense which must be specially pleaded, and the
burden of proof is upon the defendant. The court may upon its own motion
deny a divorce, even in the absence of any pleading setting up the
defense, if it appears from the record that the injured party has condoned
the acts complained of.
